Terms of Service | Bitbutler

1. Service Description

Bitbutler provides a platform that enables users to place bids on real estate properties using Ethereum (ETH). By using our service, you receive an NFT representing a pending interest associated with a pending property acquisition.

2. NFT and Property Rights

Your NFT represents a pending interest associated with a pending transaction. Property rights only vest after (a) Bitbutler successfully closes on the property, AND (b) the NFT holder completes necessary KYC/AML verification as required by the jurisdiction where the property is located. Until both conditions are met, the NFT does not convey any legal ownership rights.

3. No Guarantees and Refunds

Real estate purchases involve risk. We do not guarantee successful acquisition of any particular property. If Bitbutler fails to close on a property, your deposit will be refunded minus blockchain transaction fees and any administrative costs already incurred. Refunds will be processed within 60 days of transaction failure.

4. Blockchain Transactions

All transactions occur on the Ethereum blockchain. Blockchain transactions are irreversible. You are responsible for verifying all transaction details.

5. User Responsibilities

You are responsible for maintaining wallet security, complying with all applicable laws (including KYC/AML requirements), and paying all associated bills including but not limited to taxes, maintenance fees, insurance, and any fees incurred by the platform. You confirm you have legal capacity to enter this agreement.

6. Limitation of Liability

Bitbutler's liability is limited to the fees you paid. We are not liable for indirect damages, lost profits, or lost opportunities.

7. Dispute Resolution

Any disputes will be resolved through binding arbitration. You waive the right to bring class action claims.

8. Modifications

We reserve the right to modify these terms at any time. Continued use constitutes acceptance of modified terms.

9. Privacy Policy

By using Bitbutler, you agree to our Privacy Policy, which describes how we collect, use, and protect your personal information. The Privacy Policy is incorporated into and forms part of these Terms of Service.
